The construction site provision represents the documentation issued during the execution of the construction works, following the need for changes or additions to the technical solution. The provision is issued by the specialized designer. It happens that during the execution various technical problems appear or the beneficiary finds that the designed situation does not correspond to what he wants. Once these changes are implemented, the situation on the ground no longer corresponds to the design, which is why certain steps are needed to fix these problems. Not all changes made can be resolved with a site disposition.

 

By means of a site disposition given by the designer of the works and with the written consent of the beneficiary, local changes to the technical solutions from the authorized projects can be admitted, without issuing a new building permit, only if this does not change the site conditions, the overall structural composition or the appearance of the construction or if the resistance and stability of the neighboring buildings are not endangered.

The site layout completes the initial technical documentation and will be included in the construction technical book.

 

 

Construction site disposition - conditions for drawing up

 

 

Local changes can be applied through a site disposal provided that the following requirements are met:

 - the function from the initial authorization is not changed;
 - compliance with the provisions of the opinions/agreements/point of view of the competent authorities for environmental protection is ensured, as well as of its administrative act as the case may be;
 - to ensure compliance with the provisions of the Romanian Civil Code;
 - location conditions are not changed (height regime, POT, CUT, alignment, minimum distances to property boundaries, construction aspect);
 - the strength and stability of neighboring buildings are not endangered;
 - compliance with the provisions of the technical regulations in the field of fire safety is ensured;

       - It falls within the provisions above and the works that have become necessary in unpredictable cases - as a result of excavations, foundation surveys, etc. - that are carried out at existing constructions, including at historical monuments (with the approval of the competent departments of the Ministry of Culture).

 

Construction site disposition – the obligations of the persons involved

 

 

The responsibility for the technical correctness of the new solution belongs to the specialist designer, jointly with the project verifier, and the holder of the authorization has the obligation to submit the specified documents to the issuer of the building authorization.

The construction site disposition is drawn up and issued only by the specialist designer of the work and verified by the certified verifier. Otherwise, it cannot be applied in execution.

Also, the disposition of the construction site must be done to the knowledge of the beneficiary, to be accepted by him in writing.

 

When the site disposition is not enough

 

In the case of theme changes or general technical solutions, the beneficiary has the obligation not to start or stop the works, as the case may be, and to request the issuance of a new building permit. To obtain it, he will submit a new technical documentation, developed under the conditions of the changes that have occurred

 

What types of changes can a site order be issued for

 

 Examples of types of changes to technical solutions for which a site disposal is sufficient:

 

 - interior and exterior carpentry changes, if the shape, dimensions of the gaps and carpentry are preserved, in the situation where the materials from which the respective works are made are changed, with the exception of buildings declared historical monuments, in accordance with the law;
 - changes to interior painters and painters;
 - changes to the floors;
 - changes without modifying the quality and the architectural form of the quality elements, when these works are not carried out on historical monument buildings or located in protected areas;
 - temporary non-structural partitioning works;
 - changes to internal installations, to external connections, of any kind, related to constructions, within the limits of the property, the installation of local heating and domestic hot water systems with approved boilers, as well as the installation of individual air conditioning and/or metering devices of utility consumption;
 - changes to exterior painters , if the facade elements and building colors are not changed;
